Nine agreements with other states sit above every water right in Colorado. A ditch with an 1870 priority is still junior to Kansas.

The layer above the priority system

Prior appropriation decides who gets water inside Colorado. It does not decide how much water Colorado gets to keep. That is set by nine interstate compacts, two Supreme Court equitable apportionment decrees, and two treaties with Mexico — and they bind the state regardless of how senior anyone's decree is. When Colorado owes water at a state line, the State Engineer curtails within Colorado to deliver it, which is why compact compliance can shut off wells and ditches that are perfectly in priority under state law.

What this page is not. It does not compute compliance, state anyone's delivery obligation, or name official accounting points. Those belong to DWR and the compact commissions. What it does is show the compacts, the streams each one governs, and the 50 gages in our record that sit on those streams — several of them outside Colorado, because that is where the water is measured. Rio Grande Compact 1938 · Colorado · New Mexico · Texas

Apportions the Rio Grande among Colorado, New Mexico and Texas. Colorado's obligation is measured as a delivery at the Colorado-New Mexico state line on the Rio Grande and the Conejos system, and varies with how much water the year brings rather than being a fixed amount.

Colorado's delivery is measured leaving the San Luis Valley -- the Rio Grande at the state line and the Conejos system. Otowi Bridge and Elephant Butte are downstream index points for the compact's later accounting, not Colorado's own delivery gages.

Upper Colorado River Basin Compact 1948 · Colorado · New Mexico · Utah · Wyoming · Arizona

Divides the Upper Basin's share among the upper states -- Colorado receives much the largest percentage -- and apportions specific interstate tributaries, including the Little Snake between Colorado and Wyoming. It also created the Upper Colorado River Commission, which does the Upper Basin's accounting.

The Yampa, White and Dolores are Colorado's other Colorado-basin rivers; these are their lowest gages before the water leaves the state.

Colorado River Compact 1922 · Colorado · Wyoming · Utah · New Mexico · Arizona · Nevada · California

The foundational division of the Colorado River, splitting it between an Upper Basin (Colorado, Wyoming, Utah, New Mexico) and a Lower Basin (Arizona, Nevada, California) at Lee Ferry, Arizona. Everything Colorado may consume in the Colorado River basin sits underneath it. It was negotiated on a run of unusually wet years, so the water it divided has turned out to be more than the river reliably carries -- which is why shortage on the Colorado is a structural argument about the compact itself, not just a run of dry years.

The apportionments in Article III(a) are of CONSUMPTIVE USE, not of flow, and the III(d) obligation is a non-depletion floor on a ten-year aggregate. Neither is something a streamgage reads directly, which is why the record below is presented as measured flow and nothing more.

Why it matters now

Colorado is an Upper Division state. Article III(d) is not an annual delivery target -- it is a promise not to deplete the flow at Lee Ferry below 75,000,000 acre-feet across any ten consecutive years, measured in a continuing progressive series from the first of October. That rolling form is why the argument is about long dry runs rather than any single year, and why 'compact curtailment' -- curtailing post-1922 rights inside Colorado -- is discussed at all. Nothing here computes compliance or anyone's exposure.

Where “Lee Ferry” actually is

The term “Lee Ferry” means a point in the main stream of the Colorado River one mile below the mouth of the Paria River.

“Lee Ferry” (the compact point) and “Lees Ferry” (the place, and the name of the USGS gage) are different things a mile apart, and confusing them is the classic error. The compact point is below the Paria confluence; the gage is above it. Flow at Lee Ferry is therefore the mainstem gage PLUS the Paria gage.

Measured flow past Lee Ferry

Mainstem gage plus Paria, which is what the compact point actually sees: 102 water years, WY1924–2025, averaging 10.35 MAF a year. The Paria adds only 0.19% of the total — small, but it is the difference between the gage and the compact point, so it is counted rather than assumed away.

What the compact actually says
The term “Lee Ferry” means a point in the main stream of the Colorado River one mile below the mouth of the Paria River.
— Article II(e)
There is hereby apportioned from the Colorado River System in perpetuity to the Upper Basin and to the Lower Basin, respectively, the exclusive beneficial consumptive use of 7,500,000 acre-feet of water per annum, which shall include all water necessary for the supply of any rights which may now exist.
— Article III(a)
In addition to the apportionment in paragraph (a), the Lower Basin is hereby given the right to increase its beneficial consumptive use of such waters by one million acre-feet per annum.
— Article III(b)
…whenever necessary the States of the Upper Division shall deliver at Lee Ferry water to supply one-half of the deficiency so recognized [to Mexico] in addition to that provided in paragraph (d).
— Article III(c)
The States of the Upper Division will not cause the flow of the river at Lee Ferry to be depleted below an aggregate of 75,000,000 acre-feet for any period of ten consecutive years reckoned in continuing progressive series beginning with the first day of October next succeeding the ratification of this compact.

Glen Canyon Dam closed in 1963. Everything measured here since is a release, set by federal operations, and is not the flow the river delivered. No natural-flow reconstruction is attempted — that is a modelled quantity, and this page shows measurements.

Article III(d) is written as a ten-year aggregate, so that is how the measured record is summed here. Lowest ten-year total on record: 75.3 MAF through WY1972. Highest: 133.5 MAF through WY1933. Most recent: 84.4 MAF through WY2025.

This is not a compliance measure, and should not be read as one.
  • Article III(d) binds the Upper Division not to cause the flow to be depleted below the figure. That is a statement about depletion the states caused, not about what a gage read.
  • Since 1963 the flow past this point is set by releases from Glen Canyon Dam, operated federally in part to meet this very obligation. A number above the threshold reflects that management; it is not independent evidence about it.
  • The compact's own accounting, and every subsequent agreement layered on it, is done by the Upper Colorado River Commission and Reclamation — not here.

Not compacts, and often confused with them

A Supreme Court equitable apportionment is a judgment, not an agreement between legislatures; a treaty binds the United States, not Colorado directly; and a transbasin project is engineering, not law. They are kept apart here because they are decided, argued and amended in different places.
